Labour Law:
Labor law is one of the main practice areas of this Law Office. We advise and represent you in both individual and collective labor law (definitions below).
This applies to both employers and employees.
Attorney Samy Hammad was himself a personnel representative (cf. Wikipedia) for several years at a large, internationally operating airline in Germany. In addition, he was a member of the board of one of the largest trade unions in the aviation sector for several years, where he was responsible for legal affairs and legal protection.
Benefit from the experience
- as an employee representative in a large, international company,
- as a member of the executive board of a trade union, and from
- the sound training as a fully qualified lawyer (with the qualification to exercise the office of judge in Germany) and also from the many years of experience as a lawyer.
The knowledge of the procedural processes in a company from the perspective of the employees enables a very special understanding of the legal problems of the employers in setting up works councils, collective bargaining and dealing with the committees in general. For employees, the existing experience opens up a wide spectrum-be it for the individual employee, e.g., in the case of dismissals, vacation refusals, part-time work requests, etc., or also for the entire workforce as support for the establishment of a works council or in the legal accompaniment of the same.
Areas of labor law:
Labor law is actually a sub-area of civil law, but with its own jurisdiction - the labor courts are responsible for questions in this area. Otherwise, the local, regional and higher regional courts are responsible for civil law.
Labor law is divided into individual labor law and collective labor law.
Individual labor law
Individual labor law (predominantly) regulates the legal relationship between employers and employees.
Examples of the subject area: employment contract, termination, vacation, maternity leave, incapacity for work ("sick leave"), probationary period, discrimination and much more.
Collective labor law
Collective labor law regulates the legal relationship between employers or employers' associations and trade unions. In addition, co-determination in the workplace also falls within this area.
Topics include works councils/staff councils and staff representatives, collective bargaining law, collective agreements, works agreements as well as strikes on the part of employees and so-called lockouts on the part of employers.
The law office Samy Hammad advises and represents you in individual as well as in collective labor law.
